The Right of Children to Free and Compulsory Education Act, 2009 (commonly called the Right to Education Act) passed by the Parliament of India entrusted the National Commission for Protection of Child Rights (NCPCR) with the responsibility to review and assess the implementation of rights guaranteed by the Act. NCPCR has been mandated to:
“Examine and review the safeguards for rights provided by or under this Act and recommend measures for their effective implementation 31 [1 (a)]
Inquire into complaints relating to child’s right to free and compulsory education 31 [1 (b)]
Take necessary steps as provided under sections 15 and 24 of the Commissions for Protection of Child Rights Act 31 [1(c)]”
In addition, the NCPCR can make specific contributions in providing support to the Ministry of Human Resource Development (MHRD) in the implementation of the RTE Act by taking up campaigns and creating public awareness on RTE; collecting data and conducting research and presenting reports; monitoring the implementation through public hearings and social audits; building of capacities of local bodies such as Panchayati Raj Institutions (PRIs), NGOs, officials and all other stakeholders; and so on. On this background the NCPCR has established the Right to Education Division which would work specifically on children’s education as mentioned in the RTE Act.
